My husband owned two homes prior to us getting married. While married we have refinanced both those
homes into both of our names. We are now filing for divorce and he is taking the homes back but
doesnt have the credit to refinance my name off the homes. How do I protect my credit?
Legal Topic Area: Real Estate in NC

Short answer is you can't without refinancing. Most lenders will not let a spouse out of an obligation to repay without qualifying and refinancing the remaining spouse. The only control you can have is staying on as an owner until the refinance can take place. I would recommend that you speak with your family law attorney about this and make sure you are as protected as possible.
